Terms and Conditions

Welcome to PropertyLM. These Terms and Conditions (“Terms”) govern your access to and use of PropertyLM (“the Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use PropertyLM.

 

1. Acceptance of Terms

By accessing or using PropertyLM, you acknowledge that you have read, understood, and agree to these Terms. These Terms apply to all users of the Service, including property professionals, agencies, and any organisation using PropertyLM.

 

2. Accounts and Eligibility

 

Account Creation

To use the Service, you must register for an account and provide accurate, current information. You agree to keep your account details up to date.

Each user is permitted one account and must not share login credentials with any other individual unless you are on a plan that explicitly permits team access.

Eligibility

PropertyLM is intended for use by professional real estate practitioners who are legally able to enter binding agreements. You must be of legal age in your jurisdiction and authorised to use the platform in your country of residence.

Account Security

You are responsible for maintaining the confidentiality of your password and all activities that occur under your account. Notify us immediately if you suspect unauthorized access.

 

3. Subscription Plans and Free Trials

 

PropertyLM offers monthly and annual subscription plans. Plan details, inclusions, and pricing are displayed on our website or within the Service.

Monthly Plans

Billed monthly on the date of activation. Ideal for users who prefer flexibility and no long-term commitments.

Annual Plans

Billed once per year at a discounted rate.

Free Trial

We may offer a free trial to allow you to evaluate the Service. If you do not cancel before the trial ends, billing will automatically begin on your selected plan.

Automatic Renewal

All subscriptions renew automatically at the end of each billing cycle unless cancelled.

 

4. Fees, Billing, and Payment

 

Billing

Billing occurs automatically on your subscription renewal date (monthly or annually). You authorize PropertyLM to charge your chosen payment method for all fees associated with your plan.

Payment Provider

Payments are processed through Stripe. You must provide a valid payment method and keep it up to date.

No Refunds

All subscription charges are final and non-refundable, including partial months or unused access, except where required by law.

Price Changes

Prices may change in the future. We will notify you in advance before new pricing takes effect. Continued use of the Service constitutes acceptance of the updated pricing.

Taxes

All prices exclude applicable taxes, including GST, unless otherwise stated.

 

5. Cancellation Policy

 

Cancel Anytime - Yes, you read that right.

PropertyLM subscriptions have no lock-in contracts. You may cancel your plan at any time.

How to Cancel

You can cancel by:

  • Using the in-app subscription settings (if available), or

  • Emailing support@propertylm.ai from your registered email.

Your subscription will remain active until the end of your current billing period and will not renew further.

Effect of Cancellation

  • Monthly subscribers: Access continues until the end of the current monthly period.

  • Annual subscribers: Access continues until the end of the current annual term.

No refunds or prorated credits are provided for cancellations.

Account Closure

Cancelling your subscription stops future billing. Full account deletion is optional and may result in irreversible data loss.

 

6. User Data and Privacy

 

By using the Service, you consent to PropertyLM collecting and processing personal information as outlined in our Privacy Policy.

We may collect:

  • Personal details (name, email, company)

  • Usage data (interactions, feature usage)

  • Payment information (handled solely by Stripe)

We use this data to operate, improve, and secure the Service. By providing input data, you confirm you have the rights or consent to use it.

7. Intellectual Property Rights

 

Our IP

All software, designs, algorithms, trademarks, and content within the Service belong exclusively to PropertyLM or its licensors.

You are granted a limited, non-transferable license to use the Service as intended. You may not copy, reverse-engineer, sublicense, or commercially exploit any part of the platform.

Your Input & AI Outputs

You retain ownership of data you submit, but grant PropertyLM a worldwide, perpetual, royalty-free license to use, process, and derive insights from your inputs to operate and improve the Service.

AI-generated outputs are part of the Service. PropertyLM owns the generated content, but you may use it for your professional activities.

 

8. Acceptable Use Policy

 

You agree NOT to:

  • Use the Service for illegal, harmful, or abusive activities

  • Share your login credentials or allow unauthorized access

  • Attempt to bypass, probe, or disrupt security mechanisms

  • Upload content that violates intellectual property rights

  • Use bots, scrapers, or automated systems without permission

Violation may result in immediate account suspension or termination.

 

9. Service Availability and Disclaimers

 

PropertyLM aims to provide reliable uptime but makes no guarantees that the Service will be uninterrupted or error-free.

All property insights and AI-generated reports are informational only. PropertyLM does not guarantee accuracy, completeness, or suitability for legal or financial decisions. You must independently verify data for professional use.

The Service is provided “as is”, without warranties of any kind.

 

10. Support

 

Support is available via email and in-app channels where provided. Response times are not guaranteed. Feature availability may vary based on your plan.

 

11. Termination by PropertyLM

 

We may suspend or terminate your account immediately if:

  • You violate these Terms

  • You misuse the platform

  • Your payment fails and is not resolved

  • You engage in behaviour that risks our system or users

No refunds are provided for accounts terminated for cause.

 

12. Limitation of Liability

 

To the maximum extent permitted by law:

  • PropertyLM’s total liability for any claim will not exceed the amount you paid in the past 12 months, or NZD $100 if you are on a free plan.

  • PropertyLM will not be liable for indirect, incidental, or consequential damages.

 

13. Indemnification

 

You agree to indemnify and hold PropertyLM harmless from claims arising from:

  • Your use of the Service

  • Your content or data

  • Your breach of these Terms

  • Your violation of any laws or third-party rights

 

14. Governing Law and Dispute Resolution

 

These Terms are governed by New Zealand law.

Before initiating legal action, both parties agree to attempt mediation in good faith.

Unresolved disputes will be handled exclusively in New Zealand courts.

 

15. Changes to These Terms

 

We may update these Terms from time to time. Material changes will be communicated in advance by email or in-app notice. Continued use of the Service constitutes acceptance of updated Terms.
